Algorithmic Tool Disclosure (FTC Compliance)

In accordance with the Federal Trade Commission's guidance on artificial intelligence and automated decision-making systems, PCOScan discloses the following:

  • What the system does: PCOScan uses a rules-based scoring algorithm to assess self-reported symptoms against indicators derived from the 2003 Rotterdam ESHRE/ASRM PCOS diagnostic criteria. It does not use machine learning, neural networks, or generative AI.
  • What it does not do: PCOScan does not diagnose any condition. It does not replace clinical evaluation. Its output is an informational symptom pattern score, not a medical determination of any kind.
  • How scores are calculated: Each symptom answer maps to a pre-defined point value based on clinical literature. The full scoring rubric is visible in "Judge Mode" on the results page.
  • Limitations: The algorithm was not trained on patient data. It does not account for all possible PCOS presentations. Scores can be misleading if answers are inaccurate. The tool has not been validated in clinical trials.
  • Human oversight: All clinical interpretations must be made by a licensed healthcare provider. PCOScan's output should never substitute for professional medical judgment.

1. Acceptance of Terms

By accessing or using PCOScan (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and PCOScan ("we," "us," or "our"). Use of the Service by anyone under 13 is prohibited.

2. Nature of the Service — Not Medical Advice

Important Medical Disclaimer

PCOScan is an informational screening tool. It is not a medical device, does not provide medical advice, and does not establish a doctor-patient relationship.

The Service provides a structured symptom assessment based on published diagnostic criteria for educational and informational purposes only. Specifically:

  • PCOScan does not diagnose polycystic ovary syndrome or any other medical condition
  • A score or risk level generated by PCOScan is not a clinical diagnosis
  • You should not make treatment decisions based solely on PCOScan results
  • Always consult a licensed physician, gynecologist, or endocrinologist for any health concerns
  • In a medical emergency, call 911 or your local emergency number immediately — do not rely on this app

3. Account Registration

You may use the screening tool without creating an account. To access symptom tracking and save your results, you must create an account by providing a valid email address and password. You agree to:

  • Provide accurate and truthful registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access at privacy@pcoscan.app
  • Be responsible for all activity that occurs under your account

We reserve the right to terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to access another user's account or data
  • Reverse-engineer, scrape, or attempt to extract the scoring algorithm or database
  • Submit false or misleading health information with intent to circumvent or manipulate results
  • Use the Service to provide medical advice to third parties
  • Interfere with the operation of the Service or its infrastructure

5. Your Data and Content

You retain ownership of the health data and notes you enter into PCOScan. By submitting data to the Service, you grant us a limited, non-exclusive license to store and process that data solely to provide the Service to you. We do not claim any intellectual property rights over your personal health data. See our Privacy Policy for full details on how we handle your data.

6. Intellectual Property

PCOScan, its scoring methodology, design, code, and content (excluding your personal data) are owned by us and protected by applicable intellectual property laws. The Rotterdam diagnostic criteria referenced in our scoring model are the work of the ESHRE/ASRM Consensus Workshop Group and are cited for educational purposes only. We claim no proprietary rights over published medical criteria.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

We do not warrant that: (a) the Service will be uninterrupted or error-free; (b) scoring results are accurate, complete, or clinically validated; (c) defects will be corrected; or (d) the Service is free of viruses or other harmful components.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL PCOSCAN OR ITS OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100 USD. Some jurisdictions do not allow limitation of liability for personal injury or certain damages; in such jurisdictions, our liability is limited to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless PCOScan and its officers, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or third-party rights; or (d) any health decisions you make based on information from the Service.

10. Dispute Resolution and Arbitration

Please read Section 11 of our Privacy Policy, which is incorporated here by reference and governs the resolution of all disputes between you and PCOScan through binding individual arbitration, including the class action waiver and opt-out procedure.

The arbitration agreement in the Privacy Policy applies to all claims arising from these Terms of Service and your use of the Service.

11. Modifications to the Service and Terms

We reserve the right to modify or discontinue the Service at any time with or without notice. We may update these Terms periodically. We will provide reasonable notice of material changes (by email or in-app notice). Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles, except where superseded by applicable federal law or prohibited by the law of your jurisdiction.
